- The photographer will explain the purpose of the shoot and how the images will be used (e.g., commercial, personal, artistic, portfolio, etc.).
2. Ownership of Photographs
- All images captured by the photographer are owned by the photographer unless otherwise stated in a written agreement.
- Clients have the right to use images as per the agreed contract, which may include commercial usage, social media, or personal use.
3. Client/Model Consent
- Before taking any photographs, the client or model must sign a release form that outlines how the images will be used.
- Consent is required for any use beyond what is initially agreed upon (e.g., using images in promotional material or submitting them to contests).
4. Storage and Security of Images
- Photographs will be stored in a secure environment, either locally or using encrypted cloud storage.
- The photographer will take reasonable steps to ensure the safety and security of images from unauthorized access.
5. Sharing and Distribution
- Images will not be shared, sold, or distributed without the explicit consent of the client or model, except as agreed upon in the release form.
- If third parties (e.g., publications, brands) request the use of images, the photographer will seek written permission from the client or model.
6. Retention and Deletion of Images
- The photographer will retain the images for a specified period (e.g., 1 year), after which they may be archived or deleted unless otherwise agreed upon.
- Clients or models can request the deletion of their images at any time, provided there are no contractual obligations preventing this.
7. Social Media and Portfolio Use
- The photographer may use the images in their portfolio, website, or social media with the client's or model's consent.
- Consent can be revoked for future use at any time, though existing materials may not be removed unless requested.
8. Dispute Resolution
- Any disputes regarding the use of photographs will be handled through direct communication or legal channels, as outlined in the contract.
